1. The service
Fera Fitness provides personalized online fitness coaching, primarily intended for adults over 50. The service is available to adults of all genders and activity levels, subject to an initial assessment and confirmation that the service is suitable for the individual’s circumstances and goals.
The service includes a free initial video assessment, a personalized workout plan, and access to the training app designated by Fera Fitness. Plans are prepared personally by the trainer based on the assessment, the client’s goals, and the client’s feedback. Workouts are not generated by artificial intelligence.
The app includes exercise videos and lets clients view sessions, add notes, and mark workouts as complete. Workouts may be adapted for a gym, home, or another suitable space, as agreed in the client’s plan.
This is a fitness coaching service. It is not medical advice, diagnosis, physiotherapy, or other healthcare treatment. Clients should consult a qualified healthcare professional if they are unsure whether exercising is safe for them.
2. Contact request and free assessment
Submitting the website form is a request to be contacted. It does not create a contract or require payment.
Fera Fitness will contact the prospective client, preferably through WhatsApp if a phone number has been provided, or by email. An initial video assessment will then be offered free of charge and without any obligation to purchase a plan.
The assessment may include general questions about age, sex, height, weight, fitness level, training experience, and goals. Clients should not submit detailed medical information through the website form.
After the assessment, the client decides whether to proceed. If they choose to proceed, they will receive confirmation of the selected plan, price, payment instructions, and next steps. A contract is formed only after the client expressly accepts those terms and payment is confirmed.
3. Plans, prices, and payment
The following plans are available:
- €99 plan: includes 8 workout sessions, available for 30 days.
- €149 plan: includes 12 workout sessions, available for 30 days.
- €199 plan: includes 16 workout sessions, available for 30 days.
Prices in euros are the contractual prices. Any US dollar or British pound amounts shown on the website are approximate references based on the exchange rate and reference date displayed there. The client’s payment provider may apply its own exchange rate or fees.
Payment is requested only after contact and the initial assessment, using the payment method specified by Fera Fitness. Payment is made to the contracting provider identified in these terms, who is also responsible for issuing the invoice. Invoicing is handled manually at this stage.
There are no recurring payments or automatic renewals. The client will not be charged for another period unless they request and expressly accept it.
4. Plan start date and duration
The 30-day period begins on the date agreed with the client for their first workout. This date will be confirmed before the plan is activated.
Sessions included in the plan are available during that period. Clients may complete them at their own pace, in accordance with the trainer’s guidance and their individual plan.
Fera Fitness will prepare the plan after payment and the start date have been confirmed, within the timeframe communicated to the client when the plan is purchased.
5. Coaching, notes, and adjustments
During the active period, clients may add notes to exercises and at the end of sessions in the app. The trainer may review this feedback to monitor progress and adjust later workouts when appropriate.
Clients may also contact the trainer through WhatsApp with questions about their plan. WhatsApp is not an emergency service and does not replace medical care.
Adjustments depend on the information provided by the client, the selected plan, and the trainer’s professional judgment. Fera Fitness may recommend stopping or modifying an exercise if continuing it appears unsuitable.
6. Pauses
Clients may request a pause by telling Fera Fitness the date they want access to be suspended.
During a pause, access to the app is suspended and the remaining days in the purchased period are frozen. Sessions that have not yet been completed remain available when the client resumes the plan.
The client must notify Fera Fitness of the intended resumption date. The remaining period resumes when access is reactivated.
7. Repeating a plan
Clients may request to repeat a previous plan for €49 for a new 30-day period, provided they request it within 60 days after the end of their last active period.
A repeat includes WhatsApp support and plan adjustments under the same general terms as the service. There is no automatic renewal: the client must request and expressly accept the repeat and its payment.
After the 60-day period, the €49 repeat option is no longer available. A new assessment and purchase of a new plan may be required.
8. App access and training history
At the end of an active period, if the client does not purchase a repeat or a new plan, access to the app is deactivated.
If the client purchases a new plan or an eligible repeat, previous plans may remain visible in the app and be marked as completed. Notes and final reports associated with previous plans may remain available while access is active.
Training history is retained for six months after the end of the last active period, without affecting different retention periods required by law for other records, such as tax documents or payment records. At the end of the retention period, training data will be deleted or anonymized unless the law requires or permits it to be retained longer.
9. Client responsibilities and safety
The client agrees to:
- provide accurate and up-to-date information relevant to preparing the plan;
- follow safety guidance and instructions for using the app;
- exercise in a suitable space and with appropriate equipment;
- stop exercising and seek appropriate advice if they experience pain, dizziness, unusual shortness of breath, or another concerning symptom;
- keep their app login details private.
The client is responsible for ensuring that their training environment and equipment are safe. Fera Fitness does not control the environment in which the client exercises and cannot guarantee that injuries will not occur or that specific results will be achieved.
10. Cancellation, withdrawal, and refunds
Clients may request cancellation by emailing:
privacidade@ferafitness.com
Cancellation does not remove any statutory withdrawal, refund, or complaint rights that may apply in the client’s country.
Where the law provides a withdrawal period, clients may exercise that right under the applicable legal terms and deadlines. If a client expressly asks for the service to begin during that period, specific rules may apply to proportional payment for services already delivered and to any loss of the withdrawal right, depending on the applicable law. Those conditions will be presented before payment and before the service begins.
Outside any applicable statutory rights, requests to cancel, pause, or receive a refund will be assessed under applicable law and in light of the portion of the service already delivered. Nothing in these terms limits mandatory consumer rights.
11. Availability and changes
Fera Fitness will make reasonable efforts to keep the app access and coaching available during the purchased period. Temporary interruptions may occur because of maintenance, technical failures, or circumstances beyond the provider’s reasonable control.
Fera Fitness may update these terms. The version applicable to a purchase is the version shown to the client before they accept and pay for the plan. Later changes will not retroactively alter an accepted purchase unless required by law or agreed with the client.
12. Complaints and dispute resolution
Clients may submit a complaint by contacting reclamacoes@ferafitness.com or through the Complaints Book at https://www.livroreclamacoes.pt/Inicio/
Consumers resident in the EU may also contact the competent consumer alternative dispute resolution body in their country, where applicable. These terms do not exclude rights granted to consumers under mandatory laws in their country of residence.
13. Governing law
These terms are governed by the laws of Portugal, without prejudice to any mandatory consumer protection rules applicable in the client’s country of residence. Where permitted by law, disputes will be handled by the competent courts as determined under applicable law.texto
